Terms of Service

Welcome to TheLaundryMobile. These Terms of Service ("Terms") govern your use of the TheLaundryMobile mobile application and services operated by TheLaundryMobile ("we," "our," or "us").

By accessing or using our app and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using TheLaundryMobile, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Eligibility

To use TheLaundryMobile, you must:

  • Be at least 18 years of age
  • Be capable of forming a binding contract
  • Reside in or have a valid address within our service area
  • Provide accurate and complete registration information

We may request age verification at our discretion.

3. Account Registration

3.1 Account Creation

To access our services, you must create an account by providing:

  • Valid email address
  • Phone number
  • Password
  • Pickup/delivery address

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3.3 Account Accuracy

You agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

3.4 SMS Communications

By providing your phone number, you consent to receive service-related text messages including order confirmations, delivery updates, and account alerts. Message frequency varies. Message and data rates may apply.

  • Reply STOP to opt out of SMS messages
  • Reply HELP for assistance
  • You can also manage SMS preferences in app settings

Note: Disabling SMS notifications may cause you to miss important service updates including payment failures and delivery alerts

4. Our Services

4.1 Service Description

TheLaundryMobile provides on-demand laundry services including:

  • Wash & Fold: Laundering, drying, and folding of everyday garments
  • Dry Cleaning: Professional cleaning of suits, dresses, delicates, and specialty items
  • Pickup & Delivery: Scheduled collection and return of your items

4.2 Service Area

Our services are available only within designated service areas. Service availability at your address will be verified during registration or order placement.

4.3 Service Hours

Pickup and delivery times are subject to availability and may vary based on location and demand. Scheduled times are estimates and not guaranteed.

5. Orders and Pricing

5.1 Placing Orders

When placing an order, you agree to:

  • Provide accurate pickup and delivery information
  • Ensure items are ready for pickup at the scheduled time
  • Follow packaging and preparation guidelines

5.2 Pricing

  • Prices are based on weight (per pound) or per item for specialty services
  • Current pricing is displayed in the app at the time of order
  • We reserve the right to modify pricing with notice to users
  • Final charges are calculated after items are weighed and processed

5.3 Estimates

Any price estimates provided before processing are approximate. Final charges may vary based on actual weight and items received.

5.4 Minimum Orders

Minimum order requirements may apply and will be communicated at checkout.

6. Payment Terms

6.1 Payment Methods

We accept payment through credit/debit cards processed securely via Stripe. You agree to provide valid payment information and authorize us to charge your selected payment method.

6.2 Billing

  • Payment is processed after your order is completed
  • You will receive an itemized receipt via email and in-app
  • All charges are in US dollars unless otherwise specified

6.3 Failed Payments

If payment fails, we may:

  • Attempt to charge your payment method again
  • Suspend your account until payment is resolved
  • Pursue collection of outstanding amounts

6.4 Disputes

Payment disputes should generally be reported within 30 days of the transaction. Contact us at corporate@thelaundrymobile.com to resolve billing issues.

6.5 Refunds

  • Service issues: If we fail to deliver services as described, you may be eligible for a full or partial refund at our discretion
  • Damaged/lost items: Compensation is provided per Section 9.3
  • Subscription refunds: See Section 7.3

7. Membership Plans

7.1 Subscription Options

We offer various membership plans with different benefits:

  • Pay-As-You-Go: No commitment, standard pricing
  • Preferred Member: Discounted rates and priority service
  • Premium Member: Best pricing and fastest turnaround

7.2 Subscription Billing

  • Subscriptions are billed on a recurring basis
  • You authorize automatic charges to your payment method
  • Billing cycles begin on your subscription start date

7.3 Cancellation

  • You may cancel your subscription at any time through the app
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods, except where required by applicable law
  • You will retain benefits until the end of your paid period

7.4 Plan Changes

  • You may upgrade or downgrade your plan at any time
  • Changes take effect at the start of the next billing cycle
  • Upgrades may be applied immediately with prorated charges

8. Pickup and Delivery

8.1 Scheduling

  • Select available pickup and delivery windows through the app
  • Ensure someone is available or items are accessible at scheduled times
  • Reschedule at least 2 hours before your scheduled window

8.2 Missed Pickups

If we are unable to complete a pickup due to:

  • Items not being available
  • Incorrect address or access issues
  • No response at the location

A missed pickup fee may apply, and you will need to reschedule.

8.3 Delivery

  • Items will be delivered to the address specified in your order
  • You authorize us to leave items at your designated location
  • Delivery confirmation consists of photo proof and timestamp recorded by our driver
  • Risk of loss transfers to you upon delivery confirmation

8.4 Delivery Partners

Our delivery partners are required to follow our code of conduct, which includes professional behavior, careful handling of items, and respect for your property.

9. Item Care and Liability

9.1 Care Instructions

  • We follow standard industry practices for cleaning
  • Special care instructions must be noted at order placement
  • Remove all items from pockets before pickup
  • We are not responsible for items left in pockets

9.2 Prohibited Items

The following items are not accepted:

  • Hazardous or flammable materials
  • Items contaminated with bodily fluids or biohazards
  • Heavily soiled or infested items
  • Rugs, carpets, or oversized items (unless specified)
  • Items requiring specialized cleaning not offered

9.3 Liability Limitations

Maximum Liability:

Per-item compensation is subject to the overall liability cap in Section 15.

Exclusions: We are not liable for:

  • Pre-existing damage, wear, or defects
  • Color fading or shrinkage due to fabric characteristics
  • Items without care labels
  • Damage from improper care instructions provided
  • Items of extraordinary value not declared in advance
  • Items left in pockets
  • Normal wear from cleaning process

9.4 Claims

  • Inspect items upon delivery
  • Report damage or missing items generally within 7 days of delivery
  • Provide photos and descriptions of any issues
  • Submit claims through the app or email corporate@thelaundrymobile.com

9.5 High-Value Items

Items valued over $50 should be declared before processing. We recommend not sending irreplaceable or sentimental items.

10. User Responsibilities

You agree to:

  • Use our services only for lawful purposes
  • Provide accurate information in all interactions
  • Treat our staff and delivery partners with respect
  • Not misuse, tamper with, or attempt to exploit our services
  • Comply with all applicable laws and regulations

11. Prohibited Conduct

You may not:

  • Use our services for any illegal purpose
  • Submit false claims or fraudulent orders
  • Harass, abuse, or threaten our staff or partners
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Resell or commercially exploit our services
  • Use automated means to access our app without permission

12. Intellectual Property

12.1 Our Property

The TheLaundryMobile app, including its design, features, content, and trademarks, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

12.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes in accordance with these Terms.

13. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

14. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY

We do not warrant that:

  • Services will be uninterrupted or error-free
  • Defects will be corrected
  • The app is free of viruses or harmful components

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THELAUNDRYMOBILE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Service interruptions or failures
  • Actions of third parties

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

16. Indemnification

You agree to indemnify, defend, and hold harmless TheLaundryMobile, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your negligent or wrongful conduct

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal claim, you agree to contact us at corporate@thelaundrymobile.com to attempt to resolve the dispute informally. Most disputes can be resolved this way.

17.2 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Delaware.

Opt-Out Right: You may opt out of this arbitration provision by emailing corporate@thelaundrymobile.com within 30 days of creating your account with the subject line "Arbitration Opt-Out." Your opt-out will not affect any other provisions of these Terms.

17.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

17.4 Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

17.5 Small Claims Exception

Either party may bring qualifying claims in small claims court.

18. Termination

You may terminate your account at any time by:

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Fail to pay for services
  • Abuse our staff or systems

18.3 Effect of Termination

Upon termination:

  • Your right to use the app ceases immediately
  • Outstanding payments remain due
  • You may request deletion of your personal data in accordance with our Privacy Policy
  • Provisions that should survive termination (including Sections 9, 14, 15, 16, and 17) will remain in effect

19. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the app. Your continued use after changes constitutes acceptance of the modified Terms.

Material changes will be communicated via email or in-app notification at least 14 days before taking effect.

20. Modifications to Services

We reserve the right to:

  • Modify, suspend, or discontinue any part of our services
  • Change pricing with reasonable notice
  • Update service areas
  • Implement new features or remove existing ones

21. Force Majeure

We shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, government actions, or infrastructure failures.

22. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheLaundryMobile regarding your use of our services.

24. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

25. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

27. Acknowledgment

BY USING THELAUNDRYMOBILE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
